Fresh execution petition received by way of
assignment. It be checked and registered.
Present: None.
As per the report of the Nazir, the address of the JD
is of Hyderabad and accordingly, a transfer certificate may be
issued.
Submissions heard. Record perused.
The address of the JD as provided in the execution
petition is of Plot No. 28, Triveni Nagar, Opp. G. K. Hospital,
Balapur X Road, Hyderbad-500097 (T.S.), which is beyond the
territorial jurisdiction of New Delhi District.
In view of above, it transpires that the JD is residing/
personally working for gain within the territorial jurisdiction of
Hyderabad. Further, he has no property within the local
jurisdiction of this Court to satisfy the present decree.
Accordingly, at request, a transfer certificate be
issued in the name of Ld. Chief Judge, City Civil Court,
Hyderabad and Secunderabad enabling the DH to get the present
decree executed.
File be consigned to Record Room after necessary
compliance.
