It is submitted by Ld. counsel for the defendant that his
application under O. 8 R. 1 CPC for condonation of delay in filing the
written statement be allowed and written statement may be taken on
record. Ld. Counsel for the plaintiff has objected to the same.
Since the matter is at initial stage and in the interest of
justice, the application for condonation of delay in filing the written
statement is allowed. WS is taken on record.
Ld. Counsel for plaintiff seeks some more time to file
replication as well as reply to the application under O. 7 R. 11 CPC.
One last and final opportunity is granted to the plaintiff to
file replication as well as reply to the application under O. 7 R. 11 CPC
within four weeks from today with advance copy of the same to the other
side.
List for completion of pleadings and arguments on
application under O. 7 R. 11 CPC on 05.10.2024.
In the meanwhile, admission/denial affidavits be also filed.
