Warrants of attachment could not be executed since
the Bailiff did not receive police assistance.
Issue fresh warrants of attachment against the
movable property of the JD as per the list to the extent of the
decretal amount on filing of PF within seven days. Be put up for
appointment of bailiff before Ld. ACJ on 04.11.2025. and before
this court on 08.12.2025.
DH shall file an affidavit alongwith PF on record
that there is no stay as on date. Needless to state that bailiff has to
inquire about any stay prior to carrying the execution.
Bailiff would be at liberty to seek police assistance,
if need arises, for execution of the Warrants of Attachment.
It is hereby clarified that if a similar report is
received on the next date of hearing, the court shall be
constrained to pass an adverse order against the SHO concerned.
Copy of this order be sent to the SHO concerned for
compliance and be also annexed with the process.
