order dated 20.01.2025.
Ms. Amita Kumari, Learned Counsel for the
Defendant No.2/HDFC through VC.
Affidavit of admission/denial filed on behalf of D-2. Taken
on record. Copy Supplied.
It is stated and observed that the pleadings of the parties
are complete.
From the pleadings of the parties, the following issues are
framed:
(1) Whether the suit of the Plaintiff is bad for non-joinder of
necessary party i.e. Citi Bank as the chargeback was raised by D-1 to Citi
Bank?(OPD)
(2) Whether the Plaintiff is entitled to a decree of Rs. 1,00,000/-
against the Defendants along with interest @ 18% per annum from date
of filing of the suit till its realization along with costs of suit, as prayed
for? (OPP)
(3) Relief, if any.
No other issues are pressed by the parties.
Parties are directed to file their respective list of witnesses
within 15 days from today.
The plaintiff is directed to supply an advance copy of the
affidavits of his witnesses to the defendant(s) one week prior to the next
date of hearing.
