Counsel for petitioner submits that there are no shares of
Mahindra & Mahindra and the particulars of respondent no.2 have already
been amended vide order dated 07.01.2026 and therefore, Kfin Technologies
may be discharged. Accordingly, Kfin Technologies stands discharged.
With respect to M/s Eicher Motors Ltd, report has been
received that there are 1000 shares of M/s Eicher Motors Ltd in the name of
deceased Sharbati Devi Jalani having share certificate no. 2522 and the said
shares have been transferred to IEPF on 18.05.2022 having folio no.
0028284.
Report filed.
Accordingly, respondent no.2/Eicher Motors stands
discharged.
Evidence by way of affidavit filed on behalf of petitioners.
Further, an affidavit of consent has also been filed on behalf of
petitioners averring that succession certificate be issued in the form of 33%
in favour of petitioner no.1 and 67% in favour of petitioner no.2.
It is apprised to the parties that the present matter is a
succession petition whereby no compromise decree can be drawn.
At this stage, it is stated that the petitioners are
withdrawing the said joint application and petitioner no.1 is giving
NOC in favour of petitioner no.2 qua the issuance of succession
certificate.
Separate statement of petitioner no.1 recorded.
