Fresh execution filed. It be checked and registered as per
rules.
Present: Mr. Amit Mahaliyan, Learned Counsel for the DH
through VC.
It is requested that a Transfer Certificate be issued as
the JD(s) neither reside(s) within the jurisdiction of this Court
nor is there any property here for the satisfaction of the decree
under execution.
It is stated that the same may be transferred to the
Learned Court of the Principal District and Sessions Court,
wherein the property of the JD(s) is located.
Therefore, Transfer Certificate as per Order XXI
Rule 6 CPC may be issued with respect to the Decree, as per
rules, so that the same may be filed before the Learned
Jurisdictional Court.
It is noted that no decretal amount has been
recovered in this Execution Petition in this Court.
Nazir is directed to send the file, complete in all
respects, to the Learned Jurisdictional Court through the office
of Learned Principal District & Sessions Judge, PHC along
with the Transfer Certificate.
