Notice issued upon the plaintiffs qua the application
of the defendants No. 1 & 2 received back unserved. However,
Ld. Counsel for plaintiffs has appeared along with plaintiff No. 2.
Affidavit of compliance under Order 39 Rule 3 CPC
has been filed on behalf of the plaintiffs on 27.08.2025.
WS along with documents, reply to the application
under Order 39 Rules 1 & 2 CPC, application for vacation of
interim stay, application for preponement of next date of hearing
and vakalatnama filed on behalf of defendants No. 1 & 2 on
09.09.2025. Copies supplied.
The plaintiff is directed to file an affidavit by the
next date of hearing in view of the judgment of Hon’ble High
Court of Delhi in the case titled as “
Sudeep Kumar Vs. SDMC &
Another”, Writ Petition (Civil) No. 10794/2015. The plaintiff
shall specify whether there is any unauthorized construction in

his property and whether the property of the plaintiff is as per
sanctioned site plan.
Meanwhile, put up for report of settlement, if
any/arguments upon the application under Order 39 Rules 1 & 2
CPC and the application of the defendants for vacation of the
interim stay, on .
Meanwhile, the interim order dated 23.08.2025 is
modified to the effect that defendants No. 1 & 2 shall not
undertake
any unauthorized construction in the suit property i.e.
9091, Sector-C, Pocket-9, Vasant Kunj, New Delhi till the next
date of hearing.
Let replication, if any, be filed by the next date of
hearing with advance copy to the other side.
Put up on the date already fixed i.e. on 06.10.2025.
