Present: Mr. Krishna Roy with Mr. Satyapal, Learned
Counsel for the Plaintiff through VC.
Ms. Dipika Malhotra, Learned LAC for Defendant
No.1 with Defendant no.1 through VC.
Defendant No.2 and 3 through VC.
WS on behalf of D-1 is filed today. Ms. Malhotra
states that she received authorisation only for D-1 and not for the
other Defendants but since they are related, she shall speak with her
client and see if they are also to be represented by DLSA or not.
Learned LAC for D-1 at this stage states that she is
unable to render assistance to D-1 due to some internal logistical
difficulty with how her cases are not being updated by DLSA.
Let a copy of this order be sent to the Learned
Secretary, DLSA, PHC, to bring the same to his knowledge, with
the request to assign another LAC, if need be, so that this case can
be defended and Defendants are not prejudiced.
Learned Counsel for the Plaintiff restricts the ex-parte
ad-interim temporary injunction to the Defendants not creating third
party rights.
Till the next date of hearing, the Defendants are
restrained from creating third party rights in the suit property.
