Present: Sh. Satyakam Saini, Learned Counsel for the
Plaintiff through VC along with Sh. Ravinder Kumar
Goel, Proprietor.
Ms. Vasudha Arora, Learned Counsel for the
Defendant through VC.
Matter is listed for arguments on application filed by
the plaintiff under Section 114 of CPC for review of order dated
18.01.2025.
Learned Counsel for the Defendant submits that she
has not objection if the same is allowed as only factual errors
have been pointed out.
In the application, the plaintiff has pointed out that
inadvertently, the submissions of the defendant came to be noted
as the submissions of the plaintiff.
It is the submission of the Learned Counsel for the
Plaintiff that an observation that the submissions, as pointed out
in the application, were of the defendant, will serve his purpose.
I have seen the record and the submissions made in
the review application appear to be correct.
Accordingly, order dated 18.01.2025 is review to
the extent of clarifying that the submissions therein, as laid
out in paras no.3 (a, c, d, e & f) attributed to the plaintiff, be
read as having been made by the defendant.

Court record during the proceedings. He may, instead of him,
send the Assistant Ahlmad. The Judicial record at no time shall
be handled in the absence of the Ahlmad/Asst. Ahlmad.
17. To be added as Litigation Cost - Any default in
payment by any party may lead to it being realised as costs. All
payments made shall be redeemable as costs of litigation at the
end of the suit by the successful party.
18. Court Intervention - In case of any unforeseen
situation requiring judicial intervention, LC shall fix the date and
time for joint appearance of both sides before the Court for
removal of any such impediment. It is made clear that non-
cooperation by parties with the LC or raising unnecessary
objections may lead to their right to lead evidence or to cross-
examine, as the case may be, being closed and imposition of
costs for causing delay.
The Learned LC is directed to complete entire
evidence by the next date of hearing.
Parties are directed to contact the Learned LC
forthwith.
