Pleadings of the parties have been completed.
From the pleadings of the parties, the following issues are framed for
disposal of the suit :
1. Whether the instant suit is maintainable?(OPP)
2. Whether the plaintiff is entitled for recovery of the suit amount from the
defendant?(OPP).
3. Whether the plaintiff is entitled for any damages?(OPP).
4. Whether there is no cause of action in favour of the plaintiff to institute
the present suit?(OPD)
5. Whether there is no privity of contract between the plaintiff and defendant?
(OPD)
6. Relief
No other issue arises or is pressed for. The parties are directed to file the list
of witnesses within 15 days from today with advance copy to the opposite party.
Copy of evidence affidavit of PWs be sent in advance to the opposite party
atleast one week prior to the next date of hearing.
