Sh. Rudra Pratap Dubey, Counsel for defendant.
Matter is received back from mediation centre as unsettled.
Pleadings of the parties have been completed. Admission/denial
could not be conducted as parties have not filed admission/denial affidavit
despite directions.
From the pleadings of the parties, the following issues are
framed for disposal of the suit :-
1. Whether the plaintiff is entitled for a decree for recovery of Rs.
2,59,440/- along with future and pendentelite interest @24% per annum as
prayed in prayer clause a) of the plaint?OPP
2. Whether the plaintiff is entitled to costs of the proceedings and
litigation against the defendant as mentioned in prayer clause b) of the plaint?

3. Relief.
No other issue arises or is pressed for. The parties are directed
to file the list of witnesses within 15 days from today with advance copy to
the opposite party.
Put up for PE on 11.01.2024.
Copy of evidence affidavit of PWs be sent in advance to the
opposite party atleast one week prior to the next date of hearing.
