NEERU BATRA Vs. BURMAH SHELL CO OPERATIVE SOCIETY
AND ORS
04.11.2025
Present: Sh. Dinesh Chander, Proxy counsel for plaintiff.
Sh. Rohit Kumar Modi, Ld. counsel for defendant no. 1.
(through VC)
Sh. Somesh Arora and Ms. Reet Kaur, Ld. counsel for
defendant no. 4 (through VC)
None for the defendant no. 2 & 3.
Perusal of record reveals that matter is pending for arguments on
application u/o 7 Rule 11 CPC as per order dated 20.09.2025.
Ld. counsel for defendant no. 4, however, states that application
u/s 11 CPC as well as u/o 2 Rule 2 CPC had also been filed on behalf of
defendant no. 2 & 4 on 12.08.2024.
Ld. counsel for defendant no. 4 further states that previously he
was appearing on behalf of defendant no. 2 as well but by way of email dated
13.10.2025, defendant no. 2 has withdrawn his authority given to him.
Subject to filing of the email, Sh. Somesh Arora stands
discharged on behalf of defendant no. 2. Further, since defendant no. 2 is
aware of the pendency of the proceedings and by sending specific email
has withdrawn his vakalatnama, therefore, defendant no. 2 is at liberty to
contest the matter in person or through another counsel.
With respect to arguments on pending applications, Proxy
counsel for plaintiff submits that main counsel had suffered an injury. Medical
documents and photograph filed on record.
In view of the personal difficulty, Ld. counsel for defendants do
not oppose the request for adjournment.
Accordingly, list for arguments on aforesaid applications on
21.01.2026.
