Present: Sh. Aman Ahmad, Ld. Counsel for the DH alongwith DH in person.
Nazir has filed the report. Same be taken on record.
Record perused.
The present execution petition has been filed for enforcement of
decree/judgment passed by this court on 20.09.2018 wherein the suit was partly decreed
to the extent that defendant no.1 was directed to conduct elections of the unit committee
as per the bye laws of the society and in accordance with the other rules and regulations
of the society on or before 31.12.2018 in accordance with the statement made by
defendant no.1 on 13.08.2018.
As per the report of Nazir, DH has prayed for issuance of warrants of
attachment of properties of JD No.1 or in alternative for issuance of warrants of arrest
against the office bearers of JD No.1. Further, as per the affidavit filed by the DH, no
appeal is pending against the decree and no stay order has been received from the
appellate court till date.
Issue notice of the present execution petition to JD, on filing of PF,
returnable on 25.09.2021.
Steps be taken today itself.
