Defendant No.2 is already proceeded ex-parte by
order dated 07.12.2024.
Matter is listed for ex-parte PE and plaintiff has filed
a list of witnesses and evidence by affidavit of the Plaintiff. Taken
on record.
Defendant No. 1 has filed a WS along with a separate
application under Section 5 of the Limitation Act and yet another
application under Section 114 CPC seeking review of order dated
23.01.2026.
D-1 has not bothered to supply a copy to the Plaintiff
in advance, to which Learned Counsel for the Plaintiff has taken
objection.
On inquiry, Learned Counsel for the Defendant No. 1
states that he did not have the details of Counsel for the Plaintiff
and that the WS was in fact drafted by his client in Bhopal and he
has been simply given the same to file in Court.
Copy of both are supplied to the Plaintiff in Court.
Reply, if any, be filed within four weeks from today, with an
advance copy to the other party/parties.
