Shri Barun Dey, Ld. Counsel for defendant along with defendant in person. An application to summon record from DW3 i.e. Star Health and Insurance Company has been moved on behalf of the defendant. Heard. In view of the averments made in the application, submissions advanced and in the interest of justice, the aforementioned application stands allowed. Accordingly, issue summons to DW3 on filing of PF returnable for NDOH. Another application under Section 151 CPC moved on behalf of hte defendant for recalling of DW2 to bring two other documents as mentioned in the application. He further submits that averments regarding these documents are there in the WS, however, those documents could not be brought by DW2 on the LDOH when he was examined. The application is opposed by Ld. Counsel for plaintiff. Heard. Keeping in view the averments made in the application, submissions advanced and in the interest of justice, the aforementioned application under Section 151 CPC stands allowed and accordingly, issue summons to DW2 on filing of PF returnable for NDOH. Ahlmad is directed to specify on summons to be sent to DW2 and DW3, the record as mentioned in the aforementioned applications, which needs to be summoned. Put up for DE on 03.03.2026.
