Perused.
Perusal of the plaint shows that the verification clause in
terms of Order 6 Rule 15(2) CPC, has not been signed by the plaintiff.
Hence, the plaint cannot be deemed to have been instituted in terms of
Order 4 Rule 1(3) CPC as the same is yet to comply with Order 6 CPC.
Furthermore, the suit has been filed under Order XXXVII
CPC, however, clarifications are required as to how the suit is for a
liquidated sum.
Furthermore, perusal of plaint shows that in para 6, it has
been specifically averred that deliberately invoices were issued at an
inflated rate at the request of the defendant. Clarifications are also
required in this regard.
For want of plaintiff, list for consideration/arguments on
maintainability on 16.05.2026.
