Present: Sh. Saurabh Kumar, counsel for DH.
Warrants of attachment received back unexecuted qua JD no.2.
However, address is verified and as per report the family members had obstructed
the execution of warrants.
Accordingly, fresh warrants of attachment be issued through SDM
concerned.
SDM concerned is at liberty to take the assistance of local SHO
in case in any resistance or obstruction is faced in the execution of decree.
It is however made clear that part payment shall not be a ground to
stay the warrants of attachment and SDM concerned is directed to attach the
movable properties at the said address unless the entire decreetal amount is
tendered and paid.
AR of DH is at liberty to accompany the concerned SDM or
Official delegated by him at the time of execution of the warrants of attachment.
List for report on 06.03.2026.
At this stage, application for issuance of warrants of arrest of JD
no.2 is also filed alongwith application seeking deletion of JD no.1.
For reasons stated in the application, JD no.1 stands deleted from the
array of parties.
With respect to application for warrants of arrest, same is kept
pending for next date of hearing.
