harassing the defendants one of whom is a senior citizen. He therefore
prays that the matter be dismissed in default.

Perusal of record shows that none is appearing on behalf of
the plaintiff since past few dates. Today the matter was specifically fixed
for appearance of plaintiff. However, the plaintiff as well as his authorized
counsel remain absent. In such circumstances, appearance of proxy
counsel who has neither filed any MOA nor moved any formal application
seeking exemption on behalf of plaintiff, cannot be assumed as effective
appearance.
Suit is, therefore, dismissed in default due to non appearance.
File be consigned to Record Room after due compliance.
