Ms. Amarjeet, proxy counsel for defendant through VC
(defence already struck off vide order dt. 15.12.2025)
Matter is listed for PE.
However, evidence by way of affidavit has not been filed.
Counsel for plaintiff seeks another opportunity stating that
certain clarifications are required.
Heard. Perused.
Perusal of record shows that present matter is pending for
PE since 15.12.2025.thereafter parties tried to settle the matter but to no
avail. Subsequently, on 02.04.2026, matter was listed for PE. At request,
on the said date as well, opportunity was given to the plaintiff to file the
evidence by way of affidavit, but again today no evidence affidavit has
been filed.
In these circumstances, subject to cost of Rs. 2000/- to
be paid to the defendant on or before next date of hearing, last and
final opportunity is given to file evidence affidavit if any at least 15
days prior to next date of hearing against advance copy.
List for PE on 30.11.2026.
At this stage, counsel for defendant has provided the
