Present: Sh. Neeraj Anand, Ld. Counsel for the plaintiff with plaintiff.
Matter is fixed for consideration on an application u/s 151 CPC.
As per application, plaintiff seeks summoning of the defendant at his
office address i.e. C/o. New Delhi Muncipal Council, Palika Kendra, Sansad Marg,
new Delhi and for effective service the summons be served through Secretary
NDMC.
Heard. Application perused.
In the interest of justice and material on record, abovesaid application
stands allowed.
Issue fresh summons for settlement of issues to the defendant at his
office address as mentioned in the abovesaid application on filing of PF/RC/Speed
Post/Approved Courier. PF be filed within 15 days from today.
List on 15.02.2024 for awaiting report on summons to the defendant.
The tracking report of the summons sent to the defendant through
Speed Post/approved courier along with certificate under Section 65-B of Indian
Evidence Act in its support, be filed on the NDOH.
In case of refusal, non-availability of the defendants or in the event of
his premises is found locked, the summons to the said defendant be got served by
way of affixation.
