Matter is listed for cross examination of the witness. Complainant is present in
the court premises.
Adjournment is sought by ld. counsel for the complainant on the ground that he is
unwell today. Perusal of the record reveals that the matter was listed for cross examination of
the witness on 28.11.2024 and adjournment was sought by ld. Counsel for the accused on the
ground that he was not prepared for cross examination. At his request, the adjournment was
allowed subject to cost of Rs.1000/-.
Cost has not been paid till date. In the interest of justice, one last and final
opportunity is given to the accused to cross examine the witness, subject to cost of Rs.5,000--
to be paid to the complainant. It is hereby clarified that in case the accused or his counsel do
not appear before the court, the right to cross examine the witness shall be closed.
Re-list the matter for cross examination of witness and payment of cost on
05.03.2025.
