Present : Complainant is appearing through VC.
Accused is absent.
NBWs issued vide order dt.13.12.2024 received back unexecuted with report that
the accused Upender Jain has vacated the address two years ago. The conduct of the accused
person has recorded in order sheet dt.22.10.2024, 24.10.2024, 29.10.2024 and 13.12.2024. It is
apparent from his record that he is deliberately avoiding execution of warrants.
Heard. Considered. Allowed.
Accordingly, let process under Section 82 CrPC be issued against the accused on
his last known address with directions to execute the same at least 30 days before the date
given, on filing of PF. Let the PF be filed within 07 days from today. The process server is also
directed to ensure the execution of the aforesaid process by :
1. Affixation on the main gate of the house of the accused.
2. The photographs regarding the affixation of the process in the aforesaid manner be also
filed alongwith the report.
3. By public announcement in the area.
4. To record the statement of two respectable members of the society regarding the
execution of the process in the aforesaid manner.
Process server is also directed to ensure the publication of the process in the
leading National English/Hindi/Vernacular languages newspaper having circulation in the area
of the residence of the accused.
Be put up for report on 29.04.2025.
PA is directed to upload the orders as per rules.
