Vijay Sharma, Ld. Counsel for applicant. Ld. Counsel for accused has moved an application for cancellation of NBWs issued against the accused vide order dated 17.04.2023 along with fresh vakalatnama on behalf of accused. Application/vakalatnama is taken on record. Perused. Ld. Counsel for accused submits that he will personally make sure that the accused be present on the NDOH without fail and such an conduct will not be repeated again in future and in view of the same NBWs should be cancelled against the accused. Accordingly, NBWs against the accused are stayed till NDOH subject to cost of Rs. 500/- to be deposited in DLSA, New Delhi. Offence being bailable in nature accused is admitted to Court bail, subject to furnishing bail bond/ surety bond in sum of Rs.30,000/- with one surety of like amount. It is submitted that no sound surety is available today. Personal bonds along with proper bonds be furnished on the NDOH. Copy of this order be given dasti to the counsel of the accused and same to be treated as robkar. Put up for appearance of accused/framing of notice/consideration on bail on 30.05.2023.
