Process u/s 82 Cr.P.C not issued as PF was not filed.
Application for cancellation of process u/s 82 Cr.P.C filed by the accused.
It is submitted by Ld counsel for accused that due to eye surgery accused
could not appear before the court on the last date. Accused is present in the court and he
seeks to be unwell.
In the interest of justice, process u/s 82 Cr.P.C are stayed till the NDOH.
Perusal of the record reveals that right to cross-examine was closed vide
order dated 29.10.2024 and thereafter, the matter was listed for statement of accused u/s
313 Cr.P.C.
Ld counsel for the accused submits that the accused is willing to settle with
the complainant. That the accused is giving amount of Rs. 1,75,000/- to the complainant
in court today.
Relist the matter on 26.05.2025 for further payment.
