Present: Sh. Raghav Narayan, Ld. Counsel for complainant along with husband
of the complainant.
None for accused.
The matter is at the stage of verification of payment to be made by the
accused person.
Ld. Counsel for complainant submits that the accused has failed to make
the payment as per his statement recorded on 30.06.2023.
Perusal of the statement of the accused recorded on 30.06.2023 shows
that the accused undertook to pay an amount of Rs. 6 lakhs to the complainant in four
equal monthly installment of Rs. 1,50,000/- each starting from 15.07.2023. However,
as per the submissions given by the complainant and his counsel, no installment has
been paid by the accused till date.
Even otherwise also, despite repeated calls none appeared on behalf of
the accused to show cause why the payment was not done by the accused in
compliance of his statement dated 30.06.2023.
It appears that the accused is deliberately/intentionally not appearing
before this court and is wasting the precious time of the court. Earlier also, NBWs
were issued against the accused to secure his presence before this court.

Considering the past conduct of the accused, it appears that the presence
of the accused person could not be secured now also otherwise than taking coercive
action against him.
Accordingly, issue non-bailable warrants against the accused
through DCP concerned, returnable for the NDOH.
Copy of this order be sent to the concerned DCP through Naib Court
Concerned.
Renotify for report on NBWs/ appearance of the accused on 03.11.2023.
PA is directed to upload the orders as per rules.
