Present: AR for complainant.
Case received by way of transfer.
It is submitted by Ahlmad that the Ahlmad of the concerned court has
not submitted the complete file.
Therefore, party/concerned Ahlmad of the transferor court is
directed to submit the complete file atleast 7 days before NDOH against receipt.
Ahlmad is directed to check the complete file, document,
ordersheet etc. while receiving the file of the transferor court.
It is observed that amount of cheque in question/mandate is lesser
than Rs.50,000/-/Rs.25,000/- and admittedly the complainant is a financial
institution and hence, the present matter is exclusively triable by the Evening
Court. Accordingly, let the present case file be put up before Ld. Evening Court
5, PHC NDD for appropriate orders on 24.02.2026 at 2pm.
Ahlmad is directed to send the complete record of the present case
to the Evening Court 5, PHC, NDD at least two days in advance and the AR of
complainant is directed to appear before the court of Evening Court 5.
