Present: Mr. Madhur Sapra, Ld. Counsel for complainant
through VC.
Matter is at the stage of issuance of Notice u/s 223
BNSS. However, in view of the ruling of Hon’ble Apex Court in
SANJABIJ TARI vs. KISHORE S. BORCAR & ANR., 2025 the need
for issuance of Notice u/s 223 BNSS has been dispensed with. Hence,
the court is proceeding to the stage of cognizance.
Perusal of present complaint evinces that the same has
been made after the expiry of prescribed period of limitation.
Accordingly, Ld. Counsel for the complainant has
moved an application seeking condonation of delay. Taken on record.
Let fresh court notice be issued to the proposed accused
upon filing of PF, and RC/Speed post/approved courier, returnable
for 25.09.2026.
Ld. Counsel for the complainant is further directed to
serve the notice through all modes including electronic mode and file
all the requisite screenshots, certificate under relevant provisions of
IEA/BSA and affidavit of service on NDOH.
Steps be taken within thirty days from today.
