I am satisfied that accused person has absconded or concealing himself so
that warrants can not be executed.
Let process u/s 82 Cr.P.C. be issued against the accused through SHO
concerned on filing of PF returnable for NDOH. Process server is directed to publicly
read the proclamation in the vicinity in which the accused ordinarily resides, one
copy of the process be also affixed to some conspicuous part of the house or to some
conspicuous place of such town or village where the residence of the accused is
located and, one copy of the process be also affixed on the Notice Board of the
Court/conspicuous part of the Court premises.
Process server who executes the process of u/s 82 Cr.P.C. shall remain present
in person before the court on NDOH for recording of his statement.
SHO concerned is further directed that all the guidelines listed in Sunil Tyagi
VS. State of NCT of Delhi are followed dated 28.06.2021. passed by Hon'ble High
Court of Delhi. Process server is further directed to send duly filled annexure C as
enumerated in the judgment and as enclosed alongwith the process.
Copy of this order be attached alongiwth the process.
Re-notify on 16.01.2024 for appearance of the accused, alternatively for
recording of statement of the process server.
