Perusal of the present complaint reveals that the
present complaint has been filed after coming into force of
Bhartiya Nagarik Suraksha Sanhita, 2023. Therefore, Bhartiya
Nagarik Suraksha Sanhita, 2023 shall apply on the complaint.
Perusal of the record further shows that the present complaint has
been filed within limitation, however, as per Section 223 of
Bhartiya Nagarik Suraksha Sanhita, 2023, cognizance of the
offence cannot be taken without giving the accused an
opportunity to be heard.
Accordingly, issue dasti Court notice to the proposed
accused to appear before this court and argue on the point of
cognizance on filing of PF/RC within 30 days from today
through speed post only alongwith all the details, returnable on
next date of hearing.
Complainant is directed to file tracking report in this
regard on the next date of hearing.
