There is pendency of more than 35,000 cases in the present court, therefore, it is not
possible to give shorter date in the cases.
Matter taken up as the same has been received by way of transfer.
Present : Ms Charu Tandon, Ld. Counsel for applicant/
complainant (in the disposed of matter) through VC.
Matter is listed for report on NBWs in terms of the
previous order.
It appears that the instant matter is a miscellaneous
execution matter. Ld. Counsel for applicant submits that the
original matter came to be disposed of by way of settlement
dated 06.12.23. The accused resiled from the terms of settlement
and accordingly, the present miscellaneous came to be moved.
It appears that list of assets has been annexed
alongwith the application.
At the stage of execution, accused has no locus to
file a reply, if any, if non compliance with the mediation
settlement has already been established.
It appears that the respondent had entered
appearance through counsel on previous dates and a direction
was given to the applicant to supply a copy thereof.
Let warrants of attachment be issued for a sum of
Rs. 1.85 crores to be executed through concerned SDM (routed
through DM concerned) on filing of PF within 2 weeks from
today.
Ld. Counsel for complainant is directed to annex the
list of assets alongwith PF.
Now to come up for report on warrants of
attachment on 04.08.26.
