Present: Sh. Kapil Sharma, Ld.Counsel for the complainant along
with AR of complainant (through VC).

Complainant submits that the present complaint has been
filed after 01.07.2024. In view of proviso to Section 223(1) of
Bhartiya Nagrik Suraksha Sahita, 2023, let notice be issued to
proposed accused to appear before this Court to argue on the aspect of
cognizance on filing of PF within 10 days from today.
It is however made clear that this notice under proviso to
Section 223(1) BNSS is not to be treated as summons and accused is
entitled to appear either in person or through Counsel. Tracking report
of notice sent through speed post be placed on record on NDOH.
In case the accused fails to appear after service of notice,
taking of cognizance of offence U/s. 138 NI Act shall be considered in
his absentia.
