Present: Ld. Counsel for complainant.
The Ld. Counsel for complainant submits that the present matter has been
filed after 01.07.2024. In view of the proviso to Section 223(1) of Bhartiya Nagrik
Suraksha Sanhita, 2023, let notice be issued to proposed accused to appear before this
court to argue on the aspect of cognizance on filing of PF within 15 days from today,
returnable for the NDOH.
The Ld. Counsel for complainant is at liberty to effect the service of
notice through all permissible modes (including whatsapp and email).
However it is made clear that this notice under proviso to Section 223(1)
of Bhartiya Nagrik Suraksha Sanhita, 2023 is not to be treated as summons and the
accused is entitled to appear either in person or through a counsel.
In case the accused fails to appear after service of notice, the court shall
proceed to take cognizance in the matter in his/her absence.
Put up for appearance of the proposed accused/further proceedings on
20.01.2026.
