In the light of the fact that not every reason for return gives rise to cause of action under section 138 of NI Act, clarification is required as to whether the reason aforementioned falls within the ambit of section 138 NI Act. Let summons be issued to the bank witness to appear and explain the reason of dishonour of the cheque in question on filing of PF within 30 days. Let a copy of cheque and return memo be sent along with the summons. Bank witness is directed to bring proper authority letter to depose in the present matter. Dasti service be allowed through all modes. Complainant is directed to ensure the presence of bank witness on the NDOH.
