complainant.
Matter is at the stage of arguments on the protest
petition.
Part arguments heard.
Before proceeding with the adjudication of the
protest petition, it would be appropriate to call for a clarification
from the IO on the following aspects:
1. Whether any effort was taken for obtaining the original
cheques from the presenting bank?
2. Whether the customer whose account was allegedly
duped has been examined during the course of
investigation. If yes, whether any statement of the said
customer has been recorded?
3. Whether any investigation was conducted qua the
alleged accused person, after obtaining the account
opening form and KYC details?
Put up for filing of report by IO and further
arguments on 25/06/2026.
Before parting with the order, it would be pertinent
to record that it has come to the judicial notice of this Court that
there are numerous other matters filed by the same complainant,
wherein based on the same mechanical investigation, similar
reports have been filed.
SHO concerned is directed to monitor all such
investigations and shall take appropriate steps for investigation,
as directed above.
Copy of this order be sent to SHO concerned.
