An application for early hearing has been filed on behalf of
complainant. It is submitted that the accused is yet to be summoned.
Considering the reasons mentioned application is allowed and file is
taken up today itself.
The present matter has been filed after 01.07.2024. In view of the
proviso to Section 223 (1) of Bhartiya Nagrik Suraksha Sanhita, 2023, let notice
be issued to proposed accused to appear before this Court to argue on the aspect of
cognizance on filing of PF within 15 days from today, returnable for the NDOH.
Ld. Counsel for the complainant is at liberty to effect the service of
notice throught all permissible modes (including whats app and email).
However, it is made clear that this notice under proviso to Section
223(1) of Bhartiya Nagrik Suraksha Sanhita, 2023 is not to be treated as summons
and the accused is entitled to appear either in person or through a counsel.
In case the accused fails to appear after service of notice, the Court
shall proceed to take cognizance in the matter in his/her absence.
Re notify for appearance of the complainant as well as proposed
accused/further proceedings on 12.02.2026.
