There is pendency of more than 19,000 cases in the present court, therefore,
it is not possible to give shorter date in the cases.
Present : AR of the complainant in person.
Sh. RK Mittal, Ld. Counsel for complainant through
VC.
None for proposed accused no.1 to 3.
Matter is listed for orders/ tracing of the file.
Vide separate order of even date, the application
moved by Ld. Counsel for complainant for impleadment of
proposed accused No.4 and 5 stands allowed.
Let notice on the present complaint be issued to the
proposed accused No.4 and 5 in terms of the proviso to section
223 (1) BNSS upon filing of PF within two weeks from today
returnable for 11.12.25. If the proposed accused fails to appear
on the NDOH (provided the notice is effectively served on the
proposed accused and he is made aware of the court proceedings
against him), the requirement of serving notice before taking
cognizance u/s 138 NI Act shall stand fullfilled and the court will
proceed with issuance of summons.
Ld. counsel for complainant is at liberty to serve the
notice on the proposed accused through all permissible modes.
The Ahlmad shall ensure filing of duplicate copy of
complaint along with PF.
