Order Details: COPY OF ORDER Pdf Text: Ct Cases / 2982/2024 Jagat Singh Vs. Col V K Kapoor 17.09.2025 Present: Complainant in person. ORDER 1. The present application has been filed by the complainant Jagat Singh under Section 156(3) Cr.P.C. seeking directions to the police for registration of FIR against accused Col. V.K. Kapoor for offences under Sections 67 IT Act and 166/167/170/506/120B/34 IPC. 2. It is alleged in the complaint that the accused, in connivance with others, fraudulently lodged a grievance on the CPGRAMS portal in the name of the complainant with criminal intent, although the complainant never created any ID or filed any grievance on the portal. According to the complainant, this amounts to cybercrime and has been done to tarnish his image and to harass him due to his pending departmental disputes. 3. An Action Taken Report (ATR) has been filed by PS Delhi Cantt. It states that inquiry was conducted and the complainant was asked to produce documentary evidence to substantiate his allegations, but no such supporting material was submitted. During inquiry, it was also revealed that the complainant is involved in departmental proceedings arising from loan defaults and indiscipline, and a penalty has already been imposed upon him. The police report further notes that the CPGRAMS grievance may have been filed by the complainant himself in relation to his pending service disputes, -- 1 of 2 -- and no material has come on record to suggest that the accused had committed any cybercrime or forged any complaint in the complainant’s name. On the contrary, the accused, during inquiry, denied the allegations and stated that he would cooperate with the court proceedings. 4. Having considered the material on record and the ATR, I am of the opinion that no cognizable offence is made out against the accused persons so as to warrant registration of FIR. The allegations made by the complainant appear to be arising out of service disputes with his department and are primarily of a civil/departmental nature. The complaint is entirely based on assumptions and suspicions without any cogent evidence to show that the accused created any false grievance on CPGRAMS. 5. At this stage, it is settled law that the power under Section 156(3) Cr.P.C. is to be exercised cautiously and only when the complaint discloses the commission of a cognizable offence requiring police investigation. Mere bald allegations without supporting material are insufficient for directing registration of FIR. 6. In view of the above, the application of the complainant under Section 156(3) Cr.P.C. is dismissed. The complainant, however, is at liberty to lead his own evidence under Section 200 Cr.P.C., if he so desires. Put up for PSE on 19.03.2026. (Ankit Garg) JMFC-08, PHC, ND 17.09.2025 -- 2 of 2 --
