with complainant.
Mr. Manish Kumar Jain, Ld. counsel for accused
appeared through VC.
Accused in person.
Ld. counsel for complainant states that the matter could
not be settled in mediation.
Notice under Section 274 of BNSS explaining the
substance of the accusation has been served upon the accused today
to which he has pleaded not guilty and has claimed trial. His
defence to the alleged offence has also been recorded in accordance
with the law laid down by the Hon’ble High Court of Delhi in
Rajesh Aggarwal Vs. State of NCT decided on 28.07.2010.
The statement of defence of accused person reveals a
specific defence. Hence, the accused person is allowed to cross

examine the complainant witness in accordance with Section 145(2)
of NI Act. It is desirable that evidence be recorded in full. Hence,
this case shall now be tried as summons case.
Admission denial of documents conducted under
Section 330 BNSS in view of the same, witnesses mentioned at
serial no. 2, 3, 4 and 5 are hereby dropped as they are formal
witnesses.
