IO/SI Narender Kumar in person. At the outset, it should be noted that there are serious allegations against the accused persons related to the offence of attempt to commit culpable homicide. The accused person shave allegedly assaulted the victim with a brick on her head due to which the victim sustained injury. There are clear and specific allegations against the accused persons in the present case. Despite that these accused persons were bound down during the course of investigation. It has come to the notice that the investigating agency is not following a standard or uniform practice in the cases involving offences punishable with maximum imprisonment of 7 years. In some cases, the IOs are arresting the accused and in some cases, the accused persons are only being bound down. This becomes concerning when such different actions are being done in cases involving similar set of facts and circumstances. In this case also, the IO could not provide any satisfactory answer as to why the accused persons have not been arrested when their names and roles have been mentioned specifically in the complaint given by the complainant. Let notice be issued to the SHOs of all the Police Stations pertaining to the jurisdiction of this Court to properly sensitize the IOs regarding the guidelines issued by Hon’ble Supreme Court in the case of Satender Kumar Antil Vs. CBI. It will also be expected from the investigating agency that a uniform practice is followed in the cases involving similar set of facts and circumstances. I have perused the charge-sheet and other materials available on record. I have also gone through the other materials including the contents of FIR, seizure memo, site plan, arrest memo, disclosure statement of the accused and statement of the witnesses etc. I hereby take cognizance of offence punishable u/s 110 & 115(2) r/w 3(5) BNS. Issue summons to the accused persons kept in column no. 11 and notice to the surety for appearance through IO/SHO concerned, returnable on 04.07.2026.
