The undersigned is also working as duty MM for today.
Present: Ms Smrati Chaturvedi, counsel for the complainant
through VC.
NBWs issued against the accused on both the
addressed received back unexecuted.
Report perused. It has been submitted on behalf of
the complainant that the accused has either absconded or is
concealing himself from appearing before this Court and service
of processes upon him.
On the basis of report and submissions made, this
Court is of the view that the accused has either absconded or is
concealing himself from appearing before this Court and service
of processes upon him.
In view of the overall facts and circumstances of this
case, issue process u/s. 82 CrPC against the accused on the first
address (on filing of PF within 15 days from today) through SHO
concerned, returnable on 28/08/2024.
Process server is directed to publicly read the
proclamation in the vicinity in which the accused ordinarily
resides, one copy of the process be also affixed to some
conspicuous part of the house or to some conspicuous place of
such town or village where the residence of the accused is located
and one copy of the process be also affixed on the Notice Board
of the Court/conspicuous part of the Court premises.
SHO concerned is directed to ensure that the process
server who execute the process shall remain present in the court
on next date of hearing for recording of his statement. Copy of
this order be sent along with the process.
