Accused in person.
NDBA letter with reference no.NDBA/2025/7938 received as per which the counsels
are abstaining from work today. Hence, no adverse order is being passed.
An oral request for cancellation of NBWs has been made on the ground that the
previous counsel did not inform the accused about the LDOH and hence the accused could
not appear before this court . The accused further submits that he wishes to settle the matter
with the complainant and is ready to pay the cheque amount to the complainant. Accused
also submits that he has brought the previous cost of Rs.2000/- to be paid to the
complainant. Submissions heard and record perused.
Accused undertakes that he shall appear on each and every date in future. Heard.
Taking a lenient view in the present matter and in view of the submissions made,
NBWs issued against the accused Omendra Chauhan are hereby stayed till NDOH.
Personal bonds on record stands restored.
Proper surety documents be furnished by NDOH. Surety to appear on NDOH.
Let the previous cost of Rs.2000/-be paid to the complainant on the NDOH.
Let copy of this order be also sent to concerned SHO for intimation and compliance
and SHO is also directed to return the process to the court. Dasti allowed.
Put up for purpose fixed on 05.02.2026.
PA is directed to do updation of the case and upload the order as per rules.
