Ld. counsel for the complainant submits that she is newly engaged in the matter and
unertakes to file her vakaltnama during the course of day.
An application for cancellation of process U/s 82 Cr.PC has been moved on behalf of
the accused/ applicant, namely, Omendra Chauhan.
It is submitted that the accused was out of the station for his work related
committments and hence could not appeared before the court. The non appearance was
neither intentional nor deliberate.
Submissions heard.
Although, this court is not convinced with the reasons put forth for the non-
appearance of the accused during the case proceedings, however, taking a lenient view and
considering the submissions made in court today, process U/s 82 Cr.PC issued against the
accused/ applicant namely, Omendra Chauhan are hereby cancelled subject to cost of
Rs. 2000/- to be paid to the complainant, with a direction to the accused to remain present
on each and every date of hearing.
Since the offence u/s. 138 NI Act is bailable in nature, the accused is hereby
released on bail on furnishing of personal bond in the sum of Rs. 20,000/- with one surety of
like amount. Surety bonds has been furnished and the surety for the accused has appeared .

However, proper documents has not been furnished. He is directed to furnish the same by
NDOH.
Ld. counsel for the complainant is directed to furnish the copy of the
