Present : Ms.Smrati Chaturvedi, ld. Proxy counsel for the complainant.
NBWs received back unexecuted with repor that the premises found locked.
Accused is absent despite repeated calls. It is submitted by ld. Counsel for the
complainant that the accused is evading the court’s proceedings and deliberately not appearing
before this court. That NBWs could not be executed against accused despite best efforts. Ld.
Counsel for the complainant further prayed for issuance of process u/s 82 CrPC qua the accused.
Heard. Considered. Allowed.
Accordingly, let process under Section 82 CrPC be issued against the accused on
his last known address with directions to execute the same at least 30 days before the date given,
on filing of PF. Let the PF be filed within 07 days from today. The process server is also directed
to ensure the execution of the aforesaid process by :
1. Affixation on the main gate of the house of the accused.
2. The photographs regarding the affixation of the process in the aforesaid manner be also
filed alongwith the report.
3. By public announcement in the area.
4. To record the statement of two respectable members of the society regarding the execution
of the process in the aforesaid manner.
Process server is also directed to ensure the publication of the process in the leading
National English/Hindi/Vernacular languages newspaper having circulation in the area of the
residence of the accused.
Be put up for report on 12.03.2025.
PA is directed to upload the orders as per rules.
