Accused along with Mr. G.L Soni, Ld. Counsel for the
accused through VC.
Matter is listed for filing of application u/s 145(2) NI
Act/ CE.
No application has been filed despite opportunities being
granted vide orders dt. 20.02.2024, 02.07.2024 & 25.09.2024.
Ld. Counsel for the accused has requested for one week
time to file the appropriate application. In the interest of justice, same
is allowed subject to additional cost of Rs. 1,000/ - (in each case) to be
paid to the complainant for the delay caused with advance copy to the
opposite party.
Let previous cost be paid on or before the NDOH.
It is clarified that in case there is no application within 7
days from today, the right shall be closed.
Let both parties be present physically on the NDOH.
Let bail bonds be furnished on or before the NDOH,
failing which, the court shall be constrained to pass adverse orders
against the accused.
Be put up for filing of application u/s 145 (2) NI Act, if
any/ CE on 05.03.2025.
The date is given as per the request and convenience of
both the parties.
