Order 7 · 25 Mar 2026 · CNR DLND020191812023

Order Details: COPY OF JUDICIAL PROCEEDINGS
Pdf Text: 8 Cr Cases 6348/2023 STATE Vs. VINAY SHARMA 54/2021 (South Avenue)
25.03.2026
Present: Sh. Praveen, Ld. APP for the State.
Accused in person.
Ms. Samsun Nihar, Ld. Counsel for accused through VC.
It should be noted that as per order dt. 31.01.2025, trial in the present case has
been stayed by the Hon’ble Delhi High Court till 19.03.2025. Upon enquiry, Ld. Counsel for
accused submits that stay has not been continued by the Hon’ble Delhi High Court.
NBW issued against accused has already been recalled vide order dt. 23.02.2026.
Perusal of record reveals that the application for cancellation of NBWs was filed on the ground
that the accused is not in a stable state of mind and he is unable to understand the Court
proceedings properly. I have personally interacted with the accused and it prima facie appears
that he is able to understand the Court proceedings properly. He has only stated that he takes
sleep medicines as he is suffering from sleep disorder. The condition of sleep disorder cannot by
any stretch of imagination will make the accused mentally unstable.
Be that as it may, I find it apposite to get the accused examined from IHBAS,
Delhi in order to properly appreciate his mental condition. Let the accused be taken to IHBAS
today itself through SI Arjun, PS South Avenue.
Medical Superintendent IHBAS is requested to examine the mental condition of
the accused in order to apprise this Court as to whether the accused is suffering from
psychological condition or mental illness or not which may render him unfit to face trial.
Let copy of this ordersheet be sent to Medical Superintendent, IHBAS, Delhi
through SI Arjun.
Put up for filing of medical report of the accused on 11.04.2026.
