Report has been received from IHBAS as per which it is stated that the
accused refused to get admitted for his comprehensive assessment. It is stated that the
accused be directed for in patient admission for his comprehensive assessment after which
he will be presented before standing medical board.
At this stage, Ld. Counsel for accused submits that the accused is ready to
face trial and he may file appropriate application at the relevant stage.
Perusal of record reveals that the accused in his application filed for
cancellation for NBWs has himself stated that he is suffering from Psychosis. Perusal of
judicial record also reveals that the accused was also earlier referred to IHBAS for his
mental assessment vide order dt. 12.09.2022 passed in the present case. It is not clear as
to whether the report from IHBAS has been earlier been received or not. Ahlmad is
directed to verify the same and put up the said report before this Court on the NDOH.
Put up for further proceedings on 23.05.2026.
