matter has been called twice. However, no one has appeared on behalf of the complainant. It is to
be noted that nobody had appeared on behalf of the complainant even on LDOH.
Let Let cost of Rs.2000/- be imposed on the complainant to be paid to the accused by
the NDOH.
Ld. counsel for the accused submits that the accused suffers from cancer and has come
to the court with difficulty.
Last and final opportunity is granted to the complainant to puruse her matter failing which
the right to cross examine the accused shall be closed on the NDOH.
Ld. counsel for the accused submits that he has filed an application for waiver of
previous cost on the email ID ofthe court. Same be taken on record. It is submitted that due to a
personal difficulty of counsel for the accused , appearance could not be made before the court.
Heard.
In view of the submission made and in the interest of justice the cost imposed on the accused
on the LDOH stands waived.
Both the parties are strictly directed to appear in person on next date of hearing
failing which an adverse view shall be taken.
Put up for evidence of DW-1 on 25.03.2025.
