the complainant.
Sh. Mukesh Chandekar, Ld. counsel for accused no.1,
2, 3 & 4 along-with accused no.2 and 3.
Accused no.4 appeared through VC.
Sh. Digvijay Khapre, Ld. counsel for accused no.5
along-with accused.
Since the offence u/s 138 NI Act is bailable in nature,
the accused no.2 is hereby released on bail on furnishing of bail
bond and surety bond in the sum of Rs. 50,000/- with one surety of
like amount and subject also to the condition that the accused no.2
shall not leave the country without prior permission of the court and
shall intimate the court of any change in address either of the
accused no.2 or that of the surety. Bail Bond and surety bond
furnished. Same is accepted.
Notice u/s 251 Cr.P.C has been framed against the
accused no.3 and 5 to which they pleaded not guilty and claimed
trial. Plea of defence has been separately recorded and explained to
the accused persons.
Admission and denial of documents U/s. 294 Cr.P.C has
been done. The accused no.5 does not deny the cheque or the
signatures on the cheque. In view of the same, witness mentioned at
Sr. No. 2, 3, 4 and 5 in the list of witnesses filed by the complainant
