Ld. Counsels for the proposed accused persons seek adjournment to file
reply on the ground that copy of the complaint was recently supplied to them.
An application has been filed on behalf of proposed accused Nos. 1, 2 & 3
seeking supply of un-relied documents. It is submitted by Ld. Counsel that the said
application has been filed U/s. 230 of BNSS.
It should be noted that cognizance has not been taken in the present case
and M/s. Veecon Media and Broadcasting Limited, Jaswant Kumar Srivastava and Seema
Srivastava have not been summoned as accused. Only Court notice has been issued to
them U/s. 223 of BNSS. Copy of complaint has already been supplied to them. Since, the
said persons are not yet accused in the present case, therefore, question regarding supply
of un-relied documents U/s. 230 BNSS will not arise at this stage as the said provision is
related to the supply of documents to the accused. Therefore, the present application is not
maintainable and the same is dismissed.
