1. Arguments on the point of summoning has already been heard on behalf of
the complainant.
2. It should be noted that the present complaint was filed u/s 200 Cr.P.C
Thereafter, the pre-summoning evidence was led by the complainant on
29.01.2026. The complainant examined its AR Sh. Sushil Raturi in the pre-
summoning evidence as CW-1.
3. However, during the pendency of the present matter (before the taking of
cognisance, recording of pre-summoning evidence and issuance of process
against the accused) Bharatiya Nagrika Suraksha Sanhita, 2023 (BNSS)
replaced the Cr.P.C. Thus, the present complaint case filed by the complainant
will now be governed by the provisions of BNSS.
4. As per the proviso to section 223 of the BNSS, it is now mandatory to give
the proposed accused an opportunity of being heard before taking cognisance
on the private complaint filed and issuing of summons.
5. Therefore, in view of the above, let court notice be issued to the proposed
accused to appear in person or through his counsel on 30.05.2026.
